Terms and Conditions of Sale

These Terms and Conditions ("Agreement") govern all purchases of birds and services made through the Montana Exotic Birds LLC website (montanaexoticbirds.com) and any related transactions. Montana Exotic Birds LLC is a limited liability company registered in the State of Montana. By accessing this website or purchasing any bird or service, you agree to be fully bound by these Terms and Conditions.
1. About Montana Exotic Birds LLC
Montana Exotic Birds LLC is a licensed bird reseller established in 2026 in Bozeman, Montana. All birds are sourced from licensed and reputable aviaries and transported in compliance with applicable USDA APHIS interstate transport health certificate requirements.
2. Species We Carry
Montana Exotic Birds LLC currently carries the following species, subject to availability:
• Conures
• Finches
• Parakeets
• Cockatiels
• Lovebirds
• Indian Ring Neck Parakeets
• Quaker Parrots (Monk Parakeets) — Note: This species is banned or restricted in several states. Montana Exotic Birds LLC will verify legality in your state before completing any Quaker Parrot sale.
Species availability changes frequently. Not all species are available at all times. Please contact us at montanaexoticbirds@gmail.com to confirm current availability before placing an order or deposit.
3. Product Availability and Inventory
While we make every effort to keep our Birds For Sale page current, all birds are subject to prior sale. Availability is not guaranteed until a deposit or full payment has been confirmed in writing. Montana Exotic Birds LLC reserves the right to update inventory listings at any time without prior notice.
3.1 Special Orders
We offer a sourcing facilitation service for birds not currently in stock. Special orders may require a non-refundable sourcing deposit. If we are unable to fulfill a confirmed special order, the deposit will be refunded in full within 10 business days.
3.2 Bird Descriptions and Display
We make every effort to accurately represent the colors, markings, and features of our birds through photographs and descriptions. However, we cannot guarantee that your device's display will render colors with complete accuracy. Minor variations in appearance do not constitute grounds for return or refund.
4. Health Guarantee
4.1 Health at Time of Sale
All birds sold by Montana Exotic Birds LLC are represented as being in good health at the time of sale. Some birds are accompanied by DNA documentation from the source aviary, where applicable.
4.2 Veterinary Examination
We strongly recommend that all birds be examined by a certified avian veterinarian within 72 hours of receipt. The cost of this examination is the sole responsibility of the buyer.
4.3 Live Arrival Guarantee
Montana Exotic Birds LLC guarantees live arrival for all shipped birds. In the event of a DOA (dead on arrival), the buyer must:
• Document the condition with clear photographs immediately upon receipt
• Notify Montana Exotic Birds LLC at montanaexoticbirds@gmail.com within 2 hours of delivery
• Retain all original packaging for inspection
Failure to meet any of the above conditions voids the Live Arrival Guarantee.
4.4 Seven-Day Health Guarantee
Montana Exotic Birds LLC offers a 7-day health guarantee from the date of confirmed delivery or pickup. To make a valid health claim under this guarantee, the buyer must provide:
• A formal written report from a certified avian veterinarian confirming illness or condition
• Proof of purchase from Montana Exotic Birds LLC
• Written notice to Montana Exotic Birds LLC within the 7-day guarantee window
Upon verification of a valid claim, our liability is limited to either replacement of the bird with a bird of equal value (subject to availability) or a refund of the purchase price, at the sole discretion of Montana Exotic Birds LLC. We are not liable for any veterinary costs, boarding costs, or consequential damages incurred after the time of purchase.
4.5 Guarantee Exclusions
The health guarantee does not cover:
• Injuries or illness resulting from improper care, handling, or housing by the buyer
• Pre-existing conditions not detectable at the time of sale
• Conditions arising from exposure to other animals, household chemicals, or environmental hazards
• Any claim made after the 7-day guarantee window has expired
5. Ordering and Pickup Policy
5.1 Pickup Orders
All in-person pickup orders must be scheduled by appointment only. Walk-in pickups are not accepted. Please contact us at montanaexoticbirds@gmail.com to arrange a pickup appointment.
5.2 Appointment Area
Pickup appointments are conducted in the Bozeman, Montana area. Specific location details will be provided upon confirmation of the appointment.
6. Shipping and Delivery
6.1 Shipping Schedule
Montana Exotic Birds LLC ships birds on Mondays only, subject to weather and carrier availability. The following schedule applies:
• Orders placed by Sunday at 6:00 PM MST will ship the following Monday
• Orders placed after Sunday at 6:00 PM MST will ship on Monday of the following week
6.2 Live Arrival Requirement
Birds are shipped via climate-controlled carriers only. An adult must be present at the delivery address to receive the bird at the time of delivery. If no one is present to receive the shipment and the bird is held by the carrier or rerouted, the Live Arrival Guarantee is automatically voided, and Montana Exotic Birds LLC assumes no further liability.
6.3 Interstate Shipping Compliance
All birds shipped interstate are accompanied by the required USDA APHIS health documentation. Buyers are responsible for confirming that the species they are purchasing is legal to own and receive in their state or jurisdiction. Montana Exotic Birds LLC is not responsible for legal complications arising from destination-state import restrictions or species bans.
6.4 Shipping Risks
Once a bird has been handed over to the transport carrier, Montana Exotic Birds LLC is not responsible for carrier delays, weather-related disruptions, or other events beyond our control. The Live Arrival Guarantee applies only to confirmed DOA situations as defined in Section 4.3.
7. Payments
7.1 Payment Processing
All payments are processed securely through Stripe. We accept all major credit and debit cards. Full payment must be cleared and confirmed before any bird is shipped or released for pickup.
7.2 Non-Refundable Deposits
Deposits made to hold a specific bird or to initiate a special order are non-refundable, except in cases where Montana Exotic Birds LLC is unable to fulfill the confirmed order, in which case the full deposit will be refunded within 10 business days.
7.3 Chargebacks and Disputes
In the event of a payment dispute or chargeback, Montana Exotic Birds LLC reserves the right to provide Stripe and any relevant financial institution with all transaction records, communications, shipping documentation, and any other evidence necessary to contest the dispute.
8. Intellectual Property
All content on the Montana Exotic Birds LLC website, including but not limited to the Montana Exotic Birds logo, photographs, text, and design elements, is the exclusive property of Montana Exotic Birds LLC and is protected under applicable United States copyright law. You may not reproduce, distribute, or use our branding or content without express prior written consent from Montana Exotic Birds LLC.
9. Limitation of Liability
Montana Exotic Birds LLC is a limited liability company. To the maximum extent permitted by applicable law, Montana Exotic Birds LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase or use of any bird or service, including but not limited to:
• Veterinary costs incurred after the 7-day guarantee period
• Property damage caused by a purchased bird
• Loss of income or business disruption
• Emotional distress or consequential loss of any kind
This limitation of liability does not apply in cases of gross negligence, fraud, or intentional misrepresentation by Montana Exotic Birds LLC. Nothing in this Agreement excludes or limits liability that cannot be excluded under applicable Montana or federal law.
10. Buyer Responsibilities
By purchasing a bird from Montana Exotic Birds LLC, the buyer acknowledges and agrees to the following:
• The buyer is legally permitted to own the purchased species in their state or jurisdiction
• The buyer has adequate and appropriate housing, care, and environment for the bird prior to receipt
• The buyer assumes full responsibility for the bird's care and welfare upon confirmed delivery or pickup
• The buyer will comply with all applicable local, state, and federal laws regarding exotic bird ownership
11. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Montana, without regard to conflict of law principles. Any disputes arising under or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of Gallatin County, Montana.
Before initiating formal legal proceedings, both parties agree to attempt resolution in good faith through direct communication. Montana Exotic Birds LLC may be contacted at montanaexoticbirds@gmail.com.
12. Amendments
Montana Exotic Birds LLC reserves the right to update or modify these Terms and Conditions at any time. Changes will be posted on the website with an updated effective date. Continued use of the website or purchase of birds after any modification constitutes acceptance of the revised terms.
