Refund and Return Policy

At Montana Exotic Birds LLC, our primary concern is the health and well-being of our birds and the satisfaction of our clients. Due to the sensitive nature of live animals, our refund and return policy is as follows. This policy is governed by and consistent with our Terms and Conditions of Sale, which serve as the controlling document in the event of any conflict.
1. Live Animal Sales
1.1 Finality of Sale
All sales are considered final once a bird has left our premises or has been handed to the shipping carrier. Montana Exotic Birds LLC does not accept returns or offer refunds for the following reasons:
• Buyer's remorse
• Changes in lifestyle or personal circumstances
• Personality conflicts with the bird
• Change of mind after payment is confirmed
The only exceptions to this finality are the Live Arrival Guarantee (Section 3) and the Seven-Day Health Guarantee (Section 4), as defined in our Terms and Conditions of Sale.
1.2 Health Claims
Refunds for live birds are only considered in the event of a documented health issue as outlined in the Health Guarantee sections below. All health-related refund requests must be supported by a formal written report from a certified avian veterinarian.
2. Deposits
2.1 Non-Refundable Deposits
All deposits made to hold a specific bird or to initiate a special order are non-refundable. This applies regardless of whether the buyer changes their mind, is unable to take delivery, or requests cancellation after the deposit has been received.
2.2 Fulfillment Failure
If Montana Exotic Birds LLC is unable to fulfill a confirmed order or provide the specific bird reserved, the full deposit will be refunded within 10 business days of the confirmed fulfillment failure. This is the only circumstance under which a deposit is eligible for refund.
3. Live Arrival Guarantee
Montana Exotic Birds LLC guarantees live arrival for all shipped birds. To be eligible for a Live Arrival Guarantee claim, all three of the following conditions must be met by the buyer upon delivery:
• The bird's condition must be documented with clear photographs immediately upon receipt
• Montana Exotic Birds LLC must be notified at montanaexoticbirds@gmail.com within 2 hours of delivery
• All original packaging must be retained for inspection
Failure to satisfy any one of these conditions automatically voids the Live Arrival Guarantee, and Montana Exotic Birds LLC will assume no further liability. Someone must be present at the delivery address at the time of delivery. If the bird is held by the carrier or rerouted due to no one being present, the Live Arrival Guarantee is voided.
Upon verification of a valid Live Arrival claim, Montana Exotic Birds LLC will offer either a replacement bird of equal value (subject to availability) or a refund of the purchase price, at the sole discretion of Montana Exotic Birds LLC.
4. Seven-Day Health Guarantee
4.1 Initial Exam Requirement
To be eligible for any health-related refund or replacement claim, the bird must be examined by a certified avian veterinarian within 72 hours of confirmed delivery or pickup. This examination is strongly recommended and is a prerequisite for any health guarantee claim.
4.2 Documented Illness
A full formal written report from a certified avian veterinarian must be submitted to Montana Exotic Birds LLC for any health-related refund request. Claims submitted without veterinary documentation will not be considered. The following must be provided within the 7-day guarantee window:
• Formal written veterinary report confirming the illness or condition
• Proof of purchase from Montana Exotic Birds LLC
• Written notice sent to montanaexoticbirds@gmail.com within 7 days of confirmed delivery or pickup
4.3 Guarantee Exclusions
The Seven-Day Health Guarantee does not cover the following:
• Injuries or illness resulting from improper care, handling, or housing by the buyer
• Pre-existing conditions not detectable at the time of sale
• Conditions arising from exposure to other animals, household chemicals, or environmental hazards
• Any claim submitted after the 7-day guarantee window has expired
4.4 Resolution
Upon verification of a valid health guarantee claim, Montana Exotic Birds LLC's liability is limited to either replacement of the bird with a bird of equal value (subject to availability) or a refund of the purchase price, at the sole discretion of Montana Exotic Birds LLC. Montana Exotic Birds LLC is not responsible for any veterinary fees, boarding costs, or other medical costs incurred by the buyer at any time.
5. Shipping and Transport Costs
All shipping costs, crate fees, and DNA sexing fees are non-refundable under all circumstances, including in cases where a refund or replacement is approved under the Live Arrival Guarantee or Seven-Day Health Guarantee.
If a return is authorized by Montana Exotic Birds LLC, the buyer is solely responsible for all costs associated with return transport. Montana Exotic Birds LLC will not reimburse return shipping costs under any circumstances.
6. Governing Terms
This Refund and Return Policy is subject to and governed by the Montana Exotic Birds LLC Terms and Conditions of Sale in their entirety. In the event of any conflict or ambiguity between this Refund Policy and the Terms and Conditions of Sale, the Terms and Conditions of Sale shall control. This policy is governed by the laws of the State of Montana. Any disputes shall be subject to the exclusive jurisdiction of the courts of Gallatin County, Montana.
